THE BUTTE COUNTY COMMISSIONERS CONVENED AT 1:00 P.M. April 16, 2013. Commissioners present were Kling, Smeenk, Ager and Geis.
Chairman Kling called the meeting to order and led the group in the Pledge of Allegiance.
Motion by Smeenk Second by Geis to approve the amended meeting agenda which includes the addition of doing a First Quarter Highway Department transfer. Vote Unanimous. Motion Carried.
Motion by Smeenk Second by Ager to table the minutes from the April 2, 2013 Regular Commissioner’s meeting. Vote Unanimous. Motion Carried.
Motion by Geis Second by Smeenk to approve the Auditor’s Monthly Settlement with Treasurer report for March 31, 2013. Vote Unanimous. Motion Carried.

Motion by Geis Second by Smeenk to authorize payment of the payables per the computer printout as presented by Auditor Jensen. Vote Unanimous. Motion Carried.
Motion by Ager Second by Smeenk to accept the Register of Deeds report for March 2013. Vote Unanimous. Motion Carried.
Motion by Ager Second by Smeenk to approve the following travel requests:
Emergency Manager/E911 Coordinator/Floodplain Coordinator Martha Wierzbicki to attend a G250.7 Rapid Needs Assessment Training in Sioux Falls, SD on May 15 to May 17, 2013; Director of Equalization Polly Odle, Deputy Director of Equalization Jennifer Netterberg and Appraiser I Megin Lang to attend the SDAAO Conference in Pierre, SD on May 28 to May 31, 2013 and Civil Transport Officer Debra Jankord to attend an Advanced Jail Officer Workshop in Sioux Falls, SD on June 23 to June 25, 2013. Vote Unanimous. Motion Carried.
Commissioner Fernen arrived at 1:20 p.m.
Motion by Smeenk Second by Geis to approve a refund on parcel # 501755K for the amount of $29.02. The applicant qualifies for the Assessment Freeze for the Elderly and Disabled but missed the deadline as prescribed in SDCL 10-6A-4. Vote Unanimous. Motion Carried.
Motion by Fernen Second by Ager to approve an abatement on parcel # 708755201 for the amount of $39.38. The applicant qualifies for the Assessment Freeze for the Elderly and Disabled but missed the deadline as prescribed in SDCL 10-6A-4. Vote Unanimous. Motion Carried.
Sheriff Lamphere came before the Commissioners to address the items on the agenda pertaining to his department.
Motion by Geis Second by Ager to table the policy for a Butte County Fee Schedule. More information is needed in order to proceed. Vote Unanimous. Motion Carried.
The renovation and expansion of county facilities was discussed. It was recommended by Commissioner Geis to discuss the possible expansion with Black Hills Council of Local Governments. This discussion will continue at the next Commissioner’s meeting.
Butte County State’s Attorney Heather Plunkett came before the Commissioners to discuss the items on the agenda pertaining to the State’s Attorney’s department.
The Butte County Ambulance Service was the first item on the agenda for discussion. No action was taken.
Motion by Smeenk Second by Geis to go into an Executive Session at 2:15 p.m. regarding legal and personnel matters with State’s Attorney Heather Plunkett. Vote Unanimous. Motion Carried.
Chairman Kling recused himself at 3:35 p.m. due to a conflict of interest.
Motion by Smeenk Second by Ager to come out of Executive Session at 3:45 p.m. Vote Unanimous. Motion Carried.

Highway Superintendent Don Adams came before the Commissioners to discuss the items on the agenda pertaining to his department.
The first item of discussion was the SDDOT Pilot Program for the Bridge Structure (10-144-013) on the Harding Road. The proposal is to remove the structure and replace with an At Grade Crossing and remove the structure from the FAS Road System. SDDOT Les Hermann and Jason Hanson from Brosz Engineering, Inc. were present to discuss the program with the Commissioners. More information will be made available at the May 7, 2013 Commissioner’s meeting before a decision is made. The discussion will be held at 11:00 a.m. on May 7.
The SDDOT Weed & Pest Contract will also be discussed on May 7.
Highway Superintendent Don Adams discussed with the Commissioners the (STIP) project for the Snoma Road that is scheduled for 2015. The project is for Light Grading, Slope Flattening and AC Surfacing. The location is from 0.5S & 1.5E of the center of Belle Fourche, E0.5 mi. (Snoma Road).
Motion by Smeenk Second by Geis to authorize Brosz Engineering, Inc. to proceed with Project number P 6434(02) for 2015 on Snoma Road. Vote Unanimous. Motion Carried.
Auditor Jensen informed the Commissioners that the proceeds for the SWAP program had been receipted into the Highway Fund. The Commissioners and Highway Superintendent Don Adams discussed various chip and seal projects and gravel projects that need to be done in the County.
Highway Superintendent Don Adams discussed with the Commissioners about two 1999 Freightliner trucks that he was interested in purchasing. The trucks had previously been surplussed by Hughes County.
Motion by Geis Second by Smeenk to authorize Highway Superintendent Don Adams to go to Pierre, SD and inspect the trucks. If the trucks meet his approval he is authorized to spend $20,000.00 for each truck. Vote Unanimous. Motion Carried.
Motion by Smeenk Second by Ager to do the following First Quarter Highway Department Fund Budget and Expense Transfers: From Highway Road and Bridge Fund 201 transfer the following budget and expense amounts: $11,370.09 to Snow Fund 202, $20,511.89 to Secondary Road Fund 204 and $27,500.00 to Wheel Tax Fund 206. Vote Unanimous. Motion Carried.
Mr. Todd Fierro came before the Commissioners to discuss the possibility of selling the American West Plaza Building to Butte County for the expansion of the county facilities.
Director of Equalization/Planning Director Polly Odle came before the Commissioners with a final plat.
Motion by Smeenk Second by Geis to approve a Final Plat for Lot 1 of Tescher Estates, Located in the E2SE4 of Section 25, T9N, R4E, B.H.M., Butte County, South Dakota. Vote Unanimous. Motion Carried.
The Butte County Ag Assessments were discussed. The crop acreage reports from the FSA office are expected to arrive soon.
Emergency Manager/E911 Coordinator/Floodplain Coordinator Martha Wierzbicki came before the Commissioners to discuss the items on the agenda pertaining to her department.
Motion by Geis Second by Smeenk to accept the 2010 State Homeland Security Program Reallocation Grant for the amount of $33,210.40 and authorize Chairman Kling to sign the Reimbursement Terms and Conditions Agreement. The projects are: Belle Fourche Warning Siren, solar $21,899.00; Radios $7,010.40 and Pagers $4,301.00. Vote Unanimous. Motion Carried.
A discussion was held regarding the participation in the West River Drought Multiagency Coordination Group. The recommendation is for the Emergency Manager and one Commissioner to participate. Ms. Wierzbicki will inform the Commissioners as more information becomes available.
Motion by Geis Second by Smeenk to authorize Emergency Manager/E911 Coordinator/Floodplain Coordinator Martha Wierzbicki to apply for an Emergency Management Basic Training Course in Emmitsburg, MD. The cost to Butte County would be $97.70. The remainder of the costs is covered by FEMA. Vote Unanimous. Motion Carried.
