SIOUX FALLS - One of two Hells Angels bikers acquitted of trying to kill rival club members pleaded guilty Wednesday to a drug charge, and state prosecutors dropped the remaining charge against the pair, ending a case that started Aug. 8, 2006, in South Dakota's Black Hills.

John Midmore, 35, of Valparaiso, Ind., pleaded guilty Wednesday to a charge of having a trace amount of cocaine in his system when he was arrested.

Judge Gene Paul Kean gave Midmore a suspended imposition of sentence, so if he stays out of trouble for 90 days of probation, his record will be sealed.

The drug charge carries a maximum punishment of 10 years in prison but Kean gave Midmore credit for the 27 months he served in jail and imposed no other time.

On Nov. 20, jurors in Sioux Falls found Midmore and Chad Wilson, 33, of San Diego, not guilty of sparking a shootout at Custer State Park during the Sturgis motorcycle rally 70 miles away.

Jurors cleared the men of five counts of attempted first-degree murder and one count of commission of a felony while armed.

Three Outlaws Motorcycle Club members and two women with them suffered gunshot wounds.

Wilson is a member of a California Hells Angels chapter and Midmore is a prospect of a British Columbia group.

Prosecutors said the two intended to kill their rivals, but Wilson testified he fired a handgun in self-defense after he and Midmore were confronted by nine Outlaws at Legion Lake Resort.

Midmore has citizenship in the United States, Canada and Australia and is a resident alien. He was released on bail hours after the November verdict.

Wilson is a Canadian citizen who plans to plead guilty Thursday in Rapid City to a federal charge of being a nonimmigrant alien in possession of a firearm.

David Kenner, the men's lawyer, said Wilson likely will have to serve at least six to 11 months.

In exchange for the guilty pleas, state prosecutors dropped a charge of conspiracy to commit murder against both men.
