Grandfather sentenced to probation, fine for trial threat

CHADRON, Neb. -- A man was sentenced for his distraught actions against a Game and Parks officer after an emotional day of testimony in the death of his grandson.

Ron Britton, the grandfather of slain 16-year-old Jesse Britton, had threatened to kill Game and Parks officer Dan Kling after listening to his testimony during the trial of suspended Crawford police chief Richard Thompson on assault charges in his grandson’s death. Kling was with Thompson and also shot the youth when he pointed a gun at the officers in 2007 in Crawford.

Britton was recently sentenced to one year of unsupervised probation and fined $100 after pleading guilty in September to misdemeanor third-degree attempt of assault by menacing threats.

He was also ordered not to have any contact with Kling.

The elder Britton was originally charged with making terroristic threats toward Kling but agreed to a plea bargain on the reduced charge.

Public defender Paul Wess argued for only a small fine, and if the judge felt probation was necessary asked for it to be unsupervised.

“Obviously but for the emotion in that case, … we wouldn’t have had this problem,” Wess told the judge. “The circumstances surrounding the situation in this case lend themselves to leniency.” Wess said that his client has virtually no criminal record, except for a charge of disturbing the peace from so long ago that the fine for the crime was still $10.

Jamian Simmons, who served as special prosecutor in the case, said an unsupervised probation would be agreeable and requested the no-contact order.

Dawes County District Court Judge Brian Silverman delivered the sentence quickly, gave a brief nod to Britton and said: “That’s all. Sorry for your loss.”
