CASPER, Wyo. -- A Casper man charged with aggravated vehicular homicide said in a motion hearing that he huffed Dust Off -- a brand of pressurized air -- a few minutes before a fatal accident on March 15.

Twenty-three-year-old Justin Breazeale is accused of crossing several lanes of traffic and hitting a car driven by Madeline Rakestraw head-on. Rakestraw, who was 72, died later that day at an area hospital.

Breazeale has pleaded not guilty to aggravated vehicular homicide and driving under the influence causing serious bodily injury. He was in court Friday to ask a judge to suppress evidence found during the search of his pickup. District Judge David Park denied the request.

A trial has been set for Dec. 7.
