Two charged with rape, robbery

Two Rosebud men have pleaded not guilty to forcibly raping and robbing a Rosebud woman last November.

Jasper J. Peneaux, 18, and Christopher Prue, 18, face a four-count indictment charging them with aggravated sexual abuse, robbery and aiding and abetting. If convicted of the sexual-assault charge they could face life imprisonment. Robbery is punishable by a maximum sentence of 15 years in prison and a $250,000 fine upon conviction.

U.S. District Court documents show the men are accused of raping the woman and then stealing her cell phone and money Nov. 18, in Todd County. Peneaux and Prue were both detained pending further court proceedings.

In other federal court news:

* Tina Grimm, 48, Rapid City, pleaded guilty to conspiracy to distribute a controlled substance. According to a news release from the U.S. Attorney's Office, the charge relates to incidents that happened from Jan. 1, 2005, through Sept. 29, 2005, when Grimm conspired with others to distribute methamphetamine in the Rapid City area. The charge carries a mandatory minimum sentence of five years, with a maximum of 40 years in prison, and a $2 million fine. Sentencing was set for Oct. 10.

* Julia Poor Bear, 38, Rapid City, pleaded guilty to theft or embezzlement in connection with health care and possession of controlled substances. According to federal documents, Poor Bear admitted to defrauding the South Dakota Medicaid Program and Indian Health Services by visiting different doctors on different days at different locations in order to get prescriptions for "controlled substances which were not medically necessary." The incidents happened between Dec. 1, 2006, and May 23. The maximum penalty is 10 years in prison and a $250,000 fine. Sentencing was set for Oct. 10.

* Duane Spotted Eagle, 29, Kyle, pleaded guilty to larceny for stealing from Lil' Angels Convenience Store in Kyle. Spotted Eagle admitted to taking $3,430.74 from the store, where he worked, between April 1, 2005, and Jan. 1, 2006. Two other store employees, Danielle Spotted Eagle and Robin Two Crow, have already pleaded guilty to the same crime. The maximum penalty is five years in prison and a $250,000 fine. He will be sentenced Oct. 10.

* Patrick Iron Cloud, 25, Mission, was sentenced by U.S. District Judge Karen Schreier to four years of probation for possession with intent to distribute a controlled substance. According to a news release from the U.S. Attorney's Office, the charge involved an incident that happened Nov. 13 in Mission, when Iron Cloud possessed marijuana.

* Harold Standing Bear, 42, Norris, pleaded not guilty to a charge of distribution of a controlled substance. According to a news release from the U.S. Attorney's Office, he is accused of distributing marijuana in Mellette County on Dec. 9, 2005. The maximum penalty upon conviction is five years in prison and a $250,000 fine. Standing Bear was released pending further court proceedings.

* Permillia Mabin, also known as Angie Mabin, 28, Allen, pleaded not guilty to a charge of possession with intent to distribute a controlled substance. The charge involves an incident on April 27 near Rapid City, when Mabin allegedly possessed methamphetamine with the intent of distributing it. The maximum penalty upon conviction is 20 years in prison and a $1 million fine. No trial date was set.

* Justino Jose Dupris, also known as Justin Joe Dupris, 24, Cherry Creek, pleaded not guilty to being a drug user in possession of a firearm. According to a news release from the U.S. Attorney's Office, the charge relates to the alleged possession of a firearm July 7, 2006, in Eagle Butte. The maximum penalty upon conviction is 10 years in prison and a $250,000 fine. Dupris was released on bond pending trial.
