SIOUX FALLS - The father of two children who died in a 2005 foster home fire at Waubay is suing the Sisseton-Wahpeton tribe.
Greg Lewandowski alleges that Marlys Robertson, who ran the foster home, had more children than her license allowed.
He also claims that Tiffany Lewandowski, 7, and her brother Travis, 4, were sleeping too close to a propane heater that did not have a protective cover.
The two Lewandowski children died in the fire, as did Daniel Flynn, 4, and Joslyn BullBear, 3.
Greg Lewandowski is seeking $5 million in the federal court lawsuit against the tribe and its insurance companies.
