Judge deciding on mental state of Rapid City suspect in backyard slaying case

The mental competency of a Rapid City man accused of killing Paul Ortiz, 44, is still in question more than a year after Ortiz was shot to death at a backyard horseshoe party.

Seventh Circuit Judge Merton Tice heard Wednesday that three doctors have examined suspect Jesus Torres, 41, and they do not agree on whether Torres can stand trial.

Torres is charged with second-degree murder and an alternative count of first-degree manslaughter.

A doctor from the state's Human Services Center in Yankton said Torres is competent to stand trial, according to deputy Pennington County state's attorney Tracey Decker.

However, two doctors hired by the defense said he is not.

Now, it's up to Tice to make a decision.

A hearing allowing Tice to hear from all the doctors will be scheduled when it can be arranged, Decker said.
