A Kyle man who admitted failing to report that his wife had been physically abusing a child who later died was sentenced Wednesday to the 17 months he had been in jail.
Mitchell Wisecarver, 44, earlier pleaded guilty in federal court to misprision of a felony. His wife, Lori Wisecarver, 43, had pleaded guilty to second-degree murder in the death of 2-year-old Jayden Locke. The boy died from injuries in February 2015, a few months after the couple took custody of him.
Chief Judge Jeffrey Viken granted Mitchell’s request for a reduction in the 21 to 27 months in prison recommended in his case. The judge’s reasons included Mitchell’s accepting responsibility for his offense, his ill health from advanced lupus and the 17-1/2 months he had already served at the Pennington County Jail. He was also sentenced to a year of supervised release. Lori is set for sentencing Sept. 14.
