Jury finds Pine Ridge man guilty of rape

A federal jury has found a Pine Ridge man guilty of sexually abusing a minor child.

Roman White Calf, 20, was accused of engaging in a sexual act with a child older than 12 but younger than 16 last June in Pine Ridge. At the time, there was more than four years' difference in their ages.

White Calf is free while he awaits a detention hearing July 30. He faces up to 15 years in prison.

James Victor "B.G." McGilberry, 31, of Denver was sentenced to 151 months - 12-1/2 years - in prison by U.S. Chief Judge Karen E. Schreier for conspiring to distribute marijuana. When he is released, McGilberry will spend five years on supervised release

A jury trial found McGilberry guilty of conspiring with others to distribute more than 1,000 kilograms of marijuana in South Dakota between January 2003 and August 2008. The case was investigated by the Drug Enforcement Administration and the Unified Narcotics Enforcement Team.

In other court action:

- Jonathan McCarty, 35, Seattle, was sentenced to 121 months -10 years, one month - in prison and three years of supervised release for possession of a controlled substance with intent to distribute.

The South Dakota Highway Patrol found 14 pounds of Ecstasy hidden in McCarty's vehicle when he was stopped for speeding on Interstate 90 in March 2008. McCarty pleaded guilty in May. McCarty was immediately placed in the custody of the U.S. Marshal.

- Patrick White Mountain, 29, McLaughlin, pleaded guilty to an indictment charging him with assaulting a federal officer. White Mountain failed to restrain his dogs when he was stopped by a United States Park Ranger in Badlands National Park in October 2007. One of his dogs attacked the ranger.

A pre-sentence investigation was ordered. White Mountain is free on bond pending sentencing Oct. 26. White Mountain faces a maximum penalty of 20 years in prison.

- Jared Marquez Matthews, 26, Rapid City, pleaded guilty to conspiracy to distribute a controlled substance. Matthews is charged with conspiring with others to distribute more than 100 kilograms of marijuana in South Dakota between February 2006 and November 2007. Matthews faces a potential maximum sentence of 40 years in prison and a minimum sentence of five years in prison. The case was investigated by the DEA and UNET.

- James Smallwood, aka James Left Hand, 47, Pine Ridge, pleaded guilty to a charge of abusive sexual contact for incidents that occurred between March 2002 and March 2003 in Pine Ridge and involved a girl younger than 16. The FBI conducted the investigation. Smallwood was remanded to the custody of the U.S. Marshal pending sentencing Oct. 26. Smallwood faces a maximum penalty of three years in prison.

- Robert Black Cloud, 54, McLaughlin, pleaded guilty to failing to update his registration status as a sex offender since early 2007. Black Cloud was remanded to the U.S. Marshal pending sentencing Oct. 26. He faces a maximum penalty of 10 years in prison.

- A federal grand jury has indicted Gillman Roddy Long, aka Dave Gillman Long, 44, Pine Ridge, for aggravated sexual abuse of a child. Long pleaded not guilty before U.S. Magistrate Judge Veronica Duffy. Long remains in the custody of the U.S. Marshal. If convicted, Long faces a minimum mandatory penalty of 30 years to life in prison.

- William Warrior, 20, Oglala, was indicted by a federal grand jury for sexually abusing a minor. Warrior pleaded not guilty before U.S. Magistrate Judge Veronica Duffy. If convicted, Warrior faces a maximum penalty of 15 years imprisonment. Warrior remains in the custody of the U.S. Marshal.

- Fidel G. Diaz, 47, and Francisco J. Garcia, 27, both of Washington state, have pleaded not guilty to an indictment charging them with conspiracy to distribute a controlled substance and possession of a controlled substance. The men were caught transporting methamphetamine in South Dakota during a routine traffic stop on Interstate 90. If convicted, the minimum mandatory sentence is 10 years in prison with a potential maximum sentence of life in prison. Both remain in the U.S. Marshal's custody.

Editor's note: The U.S. District Court generally prosecutes felonies committed on reservations, while tribal courts handle misdemeanor crimes. Felonies that happen off the reservation are prosecuted in state/circuit court and are reported separately in the Journal. Some drug and firearms cases are also prosecuted in federal court.

All charges carry the possibility of fines up to $250,000 upon conviction unless otherwise noted.
