Custer State Park trademark infringement case dismissed

A Keystone business that provides Internet advertising services has reached an agreement with the state Game, Fish & Parks Department over alleged trademark infringement involving references to Custer State Park.

According to a judgment this week by U.S. District Judge Karen Schreier of Rapid City ordered the legal action dismissed.

Both sides said that the business, South Dakota Web Traveler Inc., has agreed to surrender the Internet domain names at issue in the case.

The state had claimed South Dakota Web Traveler was hijacking computer users seeking information about the park and its resorts. State officials say Web Traveler was wrongfully using these Internet domain names:

  • "sylvanlakelodge.com"
  • "stategamelodge.com"
  • "bluebelllodge.com"
  • "custerstatepark.com"
