Court revives Sheridan officer's case

CHEYENNE, Wyo. - The Wyoming Supreme Court says a district court judge was wrong to dismiss a lawsuit filed by a former Sheridan police officer trying to get his job back.

Christopher Cook was fired for his role in a 2005 traffic stop involving Sheridan Mayor Dave Kinskey. Cook called while off-duty to report that he had seen the mayor drinking at a public event. Police pulled Kinskey over, but he passed a breath test.

Sheridan Police Chief Mike Card recommended that Cook be fired, and the city's police commission agreed. Cook appealed that decision to district court.

District Judge David Park dismissed Cook's case on grounds it was improperly filed as an appeal, rather than a petition for review.

The Supreme Court on Tuesday ruled that Park was wrong when he concluded that his only option was to dismiss Cook's case. The ruling means that Cook will get another chance to argue in court that he shouldn't have been fired.
