Judge hears motions in police chief charged with murder

PIERRE - Lawyers for a former Highmore police chief who's charged with killing his wife are pressing to use testimony from an expert witness on accidental gun discharges.

Ken Huber is scheduled to go on trial Dec. 2.

His lawyers told a judge Wednesday that they need the expert's testimony to bolster Huber's claim that the shooting a year ago was accidental.

Circuit Judge James W. Anderson made no immediate ruling on the issue.

The judge did say that he won't allow all five hours of taped questioning of Huber by police but will allow snippets in which Huber says the shooting was an accident, that he knew his wife had a life insurance policy, and that he had cheated on her several times.

A prosecutor said Pam Huber had a $100,000 insurance policy that paid double for accidental death.
