A Rapid City man who torched his girlfriend's clothing during an argument was sentenced to 90 days in jail, but could go to prison if he violates his probation.

Circuit Judge Robert Mandel warned 40-year-old Ryan Hart on Thursday that it's up to him to stay out of prison. Mandel suspended the execution of a five-year prison sentence while Hart is on three years probation and ordered him to serve 90 days in jail.

Hart pleaded guilty in November to reckless burning charges stemming from a July incident. Hart took some of his girlfriend's clothing outside and set them on fire in a driveway between two homes in July.
