F/K/A RBS CITIZENS N.A., Plaintiff, vs. DELWYN OVERWEG, et al, Defendants. A Judgment and Decree of Foreclosure, having been filed on February 24, 2020, by the Circuit Court for the Fourth Judicial Circuit, Meade County, in the action entitled Citizens Bank N.A. f/k/a RBS Citizens N.A. v. Delwyn Overweg, et al, Civ. 46CIV20-000004, which Judgment and Decree of foreclosure in part directed a foreclosure sale of the following described real property in Meade County, South Dakota: Lots 3B, 4B and the North 12.5 feet of Lot 4C of lots 3 and 4 of the NW 1 SE 1 of Section 9, Township 5 North, Range 5 East of the Black Hills Meridian, City of Sturgis, Meade County, SD, as shown on the corrected plat file in plat book 3 on page 344 (aka 1623 3rd Street, Sturgis, SD 57785) Together with all improvements, easements, rights and appurtenances on or accruing to such property; NOTICE IS HEREBY GIVEN that for the purpose of realizing the sum of $169,583.73 as of February 24, 2020, plus interest accruing thereafter on said amount at the rate of 5.25% per year together with the costs and expenses of sale, will be sold subject to redemption as provided by law as one parcel of land at public auction subject to the lien for unpaid real estate taxes and assessments of Meade County, South Dakota, and easements and restrictions of record, to the highest bidder for cash, by the Sheriff of Meade County, at the front door of the Meade County Courthouse in Sturgis, South Dakota at the hour of 10:00 AM MT on January 14, 2021. Such property is that described in a Promissory Note and Mortgage dated July 14, 2017, recorded July 14, 2017 in Book 891 Page 1402 thru 1412; which mortgage was assigned to Franklin American Mortgage Company by Assignment of Mortgage recorded July 02, 2018 in Book 904 Page 37 thru 38, executed by Delwyn Overweg and Nelda Overweg, Husband and Wife, as joint tenants. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid.
