The utility reached a legal settlement in 2006 with the state and federal government by agreeing to pay them nearly $6 million for fire damage.
But the power company did not acknowledge any liability for the blaze, which charred 19 square miles of forest in the Deadwood area and destroyed seven homes in the summer of 2002.
